1- The ownership of this website (www.sma.org.tr) belongs to SMA Foundation of Turkey. The website, mobile site and mobile applications with the domain name www.sma.org.tr will hereinafter be referred to as “PORTAL”.

2- It is strongly recommended that you read and understand these Terms of Use before using PORTAL. Since some of your personal data will be processed during our use of the PORTAL, you are required to read the “KVKK Clarification Text” in the link. If you continue to use the website, it is understood that you have read and understood this text and unconditionally accept all matters.

3- Some cookie processing activities are also carried out through the PORTAL. Cookies are tools to improve your experience of using the site and the use of cookies can be terminated by the User. It is important that you read the “Cookie Policy” in the link.

4- USER refers to every natural or legal person accessing the PORTAL.

5- It is possible to donate online through the PORTAL. DONOR refers to the real/legal person User who donates via PORTAL using credit card, virtual pos, money order, etc. methods.

6- You must be at least eighteen (18) years of age to make transactions as a DONOR through the PORTAL. If you continue to use the site, it will be accepted that you have completed the age of 18.

7- TERMS OF USE may be amended in accordance with the Legislative Amendments and/or when deemed necessary by the SMA Foundation of Turkey. The amended provisions of the TERMS OF USE shall become effective on the date of announcement. It is important for the USERS to review the TERMS OF USE before the transactions to be made on different dates.

8- USERS may use the PORTAL only for lawful purposes. The legal and criminal responsibility for every transaction and action taken by the USERS within the PORTAL belongs to them.

9- The USER accepts and undertakes that the content uploaded to the site will not create any illegality in accordance with the legislation in force, will not cause any violation of rights, will not violate the Intellectual and Industrial rights of any third party, will not share data that violates the Personal or Special Qualified Personal Data of any third party. In case of any legal dispute arising in this regard, the authority and responsibility belong exclusively to the USER.

10- Turkey SMA Foundation, including the messaging carried out by the Users on the PORTAL, is not obliged to investigate, control, audit the content. The responsibility in this regard belongs exclusively to the USER.

11- Turkey SMA Foundation undertakes to keep all personal and commercial information obtained from the USER during transactions in a secure environment and to take the necessary administrative and technical measures in this regard.

12- In the event that donors make a donation by paying by credit card through Virtual Pos, credit card information is kept by the authorized payment institution and / or bank established in accordance with Law No. 6493 and Turkey SMA Foundation does not store the credit card information of any DONOR on its servers.

13- The USER accepts and undertakes that he/she will not reproduce, copy, transfer to other media, directly or indirectly, any pictures, texts, visual and audio images, video clips, files and contents, databases within the PORTAL, and will not engage in behaviors and transactions that constitute unfair competition. In case of detection of otherwise, SMA Foundation of Turkey reserves the right to take legal action.

14- Turkey SMA Foundation, in accordance with the Law No. 5651, records and stores the records of the transactions carried out by the USERS on the PORTAL within the legal period.

15- Attempting to interfere with the system by disruption, modification, reverse engineering or any other method for the whole or any part of the PORTAL, blocking the communication or technical systems of the PORTAL, carrying out attacks to disrupt, using automatic programs, robots, spiders, web crawlers, etc. on the PORTAL, unauthorized access to the data of other USERS, running bots, DDOS attacks and all kinds of attacks are prevented by the SMA Foundation of Turkey takes the necessary technical measures. In case of detection of such use, SMA Foundation of Turkey reserves the right to apply for legal remedies and to report abuse to the competent authorities.

16- SMA Foundation of Turkey reserves the right to change the information, forms, content and terms of use of the PORTAL, which services will be subject to a fee, commission rates at any time. Changes shall be effective on the date of publication on the PORTAL. Every real and legal person who benefits from PORTAL services and access to PORTAL shall be deemed to have accepted any changes made by the SMA Foundation of Turkey in these Terms of Use in advance.

17- SMA Foundation of Turkey may provide links to other websites through PORTAL. These links do not constitute a statement or guarantee for the relevant website. SMA Foundation of Turkey has no responsibility for the services, products and their contents offered on the relevant websites.

18- The trademark and logo of SMA Foundation of Turkey registered before the Turkish Patent and Trademark Office, the design, software, domain name of the PORTAL and all kinds of trademarks, designs, logos, trade dress, slogans and all other intellectual property rights of all other content created by SMA Foundation of Turkey in relation to them belong to SMA Foundation of Turkey. Users may not use, share, distribute, display, exhibit, reproduce or make derivative works from the intellectual property rights of SMA Foundation of Turkey without permission.

19- It is accepted from the beginning by the USER that the SMA Foundation of Turkey cannot be held responsible in case of interruption of the service provided on the PORTAL, disruption or delays in information transmission.

20- These Terms of Use enter into force on the date of publication on the PORTAL. USERS are deemed to have accepted the Terms of Use by using the PORTAL. Turkish Law will be applied in any dispute that may arise within the Terms of Use and Eskişehir Courts and Enforcement Offices are authorized.
